Analisis Fikih Muamalah Terhadap Praktik Arisan Kurban di Desa Babeko

Abstract

This study aims, first, to analyze the practice of sacrificial savings (arisan kurban) carried out in Babeko Village, Batin II Babeko Subdistrict, Muara Bungo Regency, and second, to analyze the fiqh muamalah perspective on the practice of sacrificial savings in Babeko Village, Batin II Babeko Subdistrict, Muara Bungo Regency. The research method used is a qualitative method in the form of a case study with an empirical approach. The primary data were obtained from interviews with the head of the sacrificial savings group in Babeko Village, Batin II Babeko Subdistrict, Muara Bungo Regency, while the secondary data were taken from books, theses, scientific works, and journals related to fiqh muamalah on sacrificial savings. The results of this study show, first, regarding the practice of sacrificial savings in Babeko Village, Batin II Babeko Subdistrict, Muara Bungo Regency. The practice of sacrificial savings consists of group members who agree to pay contributions that have been determined at the beginning. The collected funds are then used to purchase sacrificial animals, and members who have the turn to perform the sacrifice are chosen by drawing lots until all members have had their turn. Second, the practice of sacrificial savings is considered invalid (fasid) because there are problems related to the object of the contract, namely the sacrificial animal. The object does not fulfill the requirements of the contract since the fluctuating price of animals during the long period of the savings causes differences in the quality or type of sacrificial animals obtained by each member. This creates an element of gharar (uncertainty) in its implementation.
