Pemberian Hak Restitusi Bagi Korban Anak Tindak Pidana Kekerasan Seksual Oleh Penegak Hukum

Abstract

In Indonesia, the justice system for criminal sexual violence currently pays a lot of attention to victims of criminal sexual violence, one of which is the right to restitution which still needs to be improved in its fulfillment. The right to restitution is the right to compensation for losses given to the victim or their family by the perpetrator of a crime or a third party. While sexual violence is a form of violation that involves sexual behavior without the consent of another party, this can include various acts, such as rape, coercion, harassment or sexual exploitation. There is often an imbalance in the process of fulfilling the right to restitution for victims of criminal acts, especially for child victims of sexual violence who can experience very deep trauma and affect various aspects of their lives, both physically, emotionally and psychologically. In this case, the role of law enforcers, especially public prosecutors and LPKS, in fulfilling and providing the right to restitution for child victims of sexual violence is very important. The research method used is normative juridical and statutory regulations relating to research. The aim of the research is to find out about the regulation of the right to restitution for victims of criminal acts of sexual violence and the regulations in applicable laws and legal regulations. From the results of this research, it is known that in practice the implementation and provision of the right to restitution for victims of criminal acts of sexual violence is still very minimal and it is hoped that law enforcers will play an active role in encouraging the fulfillment of the right to restitution and compensation for victims.
